As an artist, I think that is a piece of conceptual art. I don't think it ever was intended to be a playhouse. (Just an opinion, I wouldn't know for sure)

Yes, you could be right. If it's conceptual art, the sign would be much less annoying.
However, I do know that many cities have removed merry-go-rounds and teeter-totters for fear of lawsuits. It's also been a federal crime to sell lawn darts since the early 80's. So it's certainly plausible that it was placed off-limits for liability reasons.
And I also agree that the people who hire the lawyers are equally deserving of opprobrium.
